Federal Judge Reaffirms Injunction Against NDAA

Judge Katherine Forrest
On Friday June 8 Friday federal judge Katherine Forrest reaffirmed her order blocking indefinite detention of any American by the Obama administration. Judge Forrest handed down her original injunction against the NDAA on May 16th. In a Motion for Reconsideration, Obama argued that her injunction prohibiting application of Section 1021 (which authorizes indefinite detention) of the NDAA applied only to the plaintiffs (see * below) named in the original lawsuit – and not other Americans.
Given that Obama’s specialty is constitutional law, his unconscionable response to a court-ordered injunction against blatantly unconstitutional legislation only strengthens the case for his impeachment. No one can be serious about preserving democratic government in the US and vote for this man in November.
In a memorandum clarifying her ruling from May 16, Judge Katherine B. Forrest of the Southern District of New York reaffirmed her earlier opinion stating plainly that her earlier order stands and that the objections raised by the White House in its request for a reconsideration were not valid.
